Erica J. Van Loon is an acclaimed intellectual property trial attorney leading the firm’s Copyright, Trademark & Media Litigation practice. For over two decades, Erica has won successful outcomes for innovative brands and individuals, including Conan O’Brien, Nike, VIZIO, the BBC, Target Corporation, ReelShort, Brittany Xavier, Vanessa Hudgens, Typical Gamer, Harley-Davidson, Silk Road, Night Crows, Dekaron, Topson Downs, and Reuben Klamer, creator of The Game of Life. Representative Cases
Defeated motion for preliminary injunction on behalf of Defendants videogame influencer Typical Gamer and Jogo Studios, Inc. in a novel copyright infringement matter concerning user generated content published on Fortnite. No. 25-cv-1969 (C.D. Cal.).
Represented Plaintiff Aimee Allison, a political strategist, in a trademark infringement matter against Netflix Inc. and Tyler Perry’s company Tyler Vision LLC, concerning their use of Plaintiff’s mark She the People as the title of a television series. The case settled shortly after defeating a motion to dismiss. No. 25-cv-4476 (C.D. Cal.).
Represented Plaintiff Wham-O, the owner of the iconic Slip ‘N Slide marks in a trademark counterfeiting and infringement suit. The case resolved with a consent judgment and settlement agreement after the close of fact discovery. No. 24-cv-0871 (W.D. N.Y.).
Took over case after the close of discovery for Plaintiff New Leaf Publishing, Inc. and defeated motion for summary judgment in a copyright infringement matter concerning six popular copyrighted films published on Plaintiff’s ReelShort mobile application. The case settled soon thereafter. No. 24-cv-4676 (C.D. Cal.).
Won a bench trial for Reuben Klamer, the author of the iconic board game, The Game of Life, on the issue of copyright ownership, which was affirmed unanimously on appeal by the First Circuit. The court was persuaded that plaintiff’s late husband’s work on the prototype of the game was a work for hire for Mr. Klamer. The court held unequivocally that Mr. Klamer was the author of the game and the owner of the copyright on it. The case also involved two separate petitions for certiorari to the U.S. Supreme Court. No. 19-1927 (1st Cir.); No. 15-cv-0419 (D.R.I.).
Won a temporary restraining order, preliminary injunction motion, and final judgment for video game developer and Plaintiff WeMade Max Co., Ltd., in a copyright dispute over Silk Road, the popular video game. No. 24-cv-12393 (N.D. Ill.).
Won a temporary restraining order, preliminary injunction motion, and final judgment for video game developer and Plaintiff Madngine, Inc.in a copyright infringement matter involving its popular online game, Night Crows. No. 25-cv-1007 (N.D. Ill.).
Won a temporary restraining order, preliminary injunction motion, and final judgment for video game developer and Plaintiff UbiFun Inc. in a copyright infringement matter involving its popular online game, Dekaron. No. 25-cv-03543 (N.D. Ill.).
Represented Plaintiff Lifetime Brands, Inc., which designs, develops and markets thousands of quality products each year for more than 30 trusted brands, in a copyright, trademark, and design patent infringement case over nine separate products, against fast-fashion giant Shein. The matter favorably settled. No. 22-cv-08037 (C.D. Cal.).
Successfully represented influencer Brittany Xavier and her company Thrifts and Threads, in a dispute over defendant’s unauthorized use of Ms. Xavier’s photo, image, and likeness on beauty products sold at major retailers such as Target and Walmart. The case settled successfully. No. 23-cv-1483 (N.D. Cal.).
Represented Heathman Enterprises in a trademark dispute over Defendants’ mark Birdie Bean for children’s apparel. The case was successfully resolved via a confidential settlement agreement after fact discovery. No. 22-cv-05474 (N.D. Cal.).
Represented Plaintiff Bego USA in a dispute concerned Defendant’s infringing use of Plaintiff’s trademarks Bego and Wironium for dental products. The case was litigated through fact discovery when it settled successfully via a confidential settlement agreement. No. 23-cv-02112 (M.D. Fla.).
Represented Correlated Magnetics Research, LLC v. Logitech in a patent infringement matter concerning magnet technology used for iPad cases. The case settled favorably. No. 21-cv-02554 (N.D. Cal.).
Represented Defendant Target Corporation and its manufacturers in a patent infringement matter concerning exercise equipment. The matter settled favorably.
Represented actress and entrepreneur Vanessa Hudgens in a suit filed against SBLA Beauty relating to violations of rights of publicity, unfair competition, and false advertising. Achieved amicable early settlement. No. 21-cv-09597 (C.D. Cal.).
Won summary judgment for British Broadcasting Corporation and affiliated entities in two lawsuits involving trademark infringement and dilution of the famous Dancing with The Stars trademarks and breach of and interference with BBC’s contracts with its professional dancers by defendants’ competing live dance shows. Won a complete dismissal of defendants’ contract interference and trademark cancellation counterclaims and dismissal of defendants’ affirmative defenses of trademark genericism and abandonment, leading to entry of a Consent Judgment and Permanent Injunction against defendants. No. 14-cv-08047 (C.D. Cal.).
Defended DECA Int’l in an 11-patent suit filed by SkyHawke Technologies over golf GPS devices. Obtained a complete dismissal with prejudice after winning favorable claim construction rulings finding 9 patents invalid or noninfringed. No. 19-cv-01692 (C.D. Cal.).
Defended DECA Int’l in a false advertising suit over gold GPS devices filed by SkyHawke Technologies, and won a motion to dismiss, dismissing 15 of 21 claims pleaded. The case settled on favorable terms on the eve of trial. No. 19-cv-07667 (C.D. Cal.).
Won partial summary judgment for Conan O’Brien, his production company, head writer, and the TBS network, finding no copyright infringement as to certain monologue jokes used on the Conan O’Brien show. No. 15-cv-01637 (S.D. Cal.).
Won summary judgment for Roche invalidating three Stanford HIV test patents for obviousness, ending Stanford’s multimillion dollar patent infringement suit. Won the case on appeal to the Federal Circuit and before the en banc court on rehearing, and won decisive victory in favor of Roche in the US Supreme Court.
Won a targeted summary judgment of non-willfulness for VIZIO against Razor USA, LLC in a trademark infringement and dilution matter. The summary judgment victory propelled the case to settle on the eve of trial, with plaintiff dropping its damages claim and agreeing to buy VIZIO’s trademarks.
Won summary judgment for Nero against JVC Kenwood, finding nine JVC optical disc patents noninfringed due to patent exhaustion and express release. The Federal Circuit affirmed the summary judgment in Nero’s favor.
Won summary judgment for plaintiff authors against executives of the Los Angeles Unified School District for copyright infringement and contributory copyright infringement.
Achieved complete dismissal for Lionsgate and Morgan Creek and its producers and writers in a copyright and trademark infringement matter concerning the Tupac Shakur biopic film, All Eyez On Me. Plaintiff dismissed the suit after receiving a Rule 11 Motion for sanctions for filing and continuing to litigate a frivolous suit.
Won TTAB Appeal for Tropicana Las Vegas reversing examiner’s refusal to register mark BACIO for restaurant services on the ground that it was confusingly similar to the registered mark KISS for the iconic band’s restaurant.
Achieved multiple consent judgments and permanent injunctions for SHFL Entertainment, Inc. against competitors in the casino and online gaming industries who infringed SHFL’s copyrights, trademarks, and patents.
Achieved injunction and substantial compensation on the eve of trial against competitor in the plush toy industry for violating the trade dress of client’s core product line.
Won defense victory for Nike in its landmark trademark case against adidas over Nike’s right to use two stripes on athletic apparel; adidas filed a broad “covenant not to sue” releasing Nike from all alleged past and present trademark claims and committing not to sue Nike over any two-striped athletic apparel or shoes throughout the United States.
Achieved no-payment settlement for car parts retailer in hard-fought suit brought by famous car maker involving numerous design patents and trademarks.
Successfully enforced Harley-Davidson’s famous Bar & Shield trademarks against competitors in the insurance industry.
